1. Introduction & Scope

These Terms and Conditions (“Terms”) govern the use of all products and services provided by Hostigo (Pty) Ltd, trading as Hostigo.co.za (“Hostigo”, “we”, “us”, or “our”).

By accessing, ordering, renewing, or using any Hostigo service, you (“Client”, “you”, or “your”) confirm that you have read, understood, and agree to be legally bound by these Terms, together with any policies referenced herein, including but not limited to our Acceptable Use Policy and Privacy Policy (where applicable).

If you do not agree to these Terms, you must not use Hostigo’s services.

These Terms apply to all clients, including individuals, businesses, and resellers.


2.Services

Hostigo provides web hosting, domain registration and management, server resources, email services, and related technical support (“Services”).

All Services are provided on an “as-is” and “as-available” basis. While Hostigo makes reasonable efforts to maintain service availability, performance, and security, no guarantees are made regarding uptime, data integrity, performance, or suitability for any specific purpose unless expressly stated in writing.

Hostigo reserves the right, at its sole discretion, to:

  • Modify, upgrade, replace, or discontinue any Service or feature

  • Change infrastructure, software, or configurations

  • Impose usage limits to protect platform stability and security

Where reasonably practicable, notice will be given; however, Hostigo is not obligated to provide notice where changes are required for security, legal, operational, or emergency reasons.


3. Client Responsibilities

You are solely responsible for:

  • All content, data, and activities conducted through your Services

  • Ensuring your use of the Services complies with all applicable laws and regulations

  • Maintaining independent backups of all data

Any backups provided by Hostigo are offered as a convenience only and do not constitute a backup or data recovery guarantee.

You agree to indemnify and hold Hostigo harmless against any claims, damages, losses, fines, or legal costs arising from your use of the Services or any breach of these Terms.


4.  Billing & Automation Authority

Hostigo utilises WHMCS for billing, provisioning, automation, and account management.

By using Hostigo’s Services, you authorise Hostigo and its automated systems to:

  • Generate invoices and billing notices

  • Process payments and apply credits

  • Automatically provision, suspend, restrict, or terminate Services

  • Perform renewals, cancellations, and enforcement actions

Automated actions may occur without human review. Hostigo shall not be liable for consequences arising from automated enforcement of these Terms.

You are responsible for ensuring all account, contact, and payment information remains accurate and up to date in the client portal.


5. Payments, PayFast & Refunds

Payments are processed via PayFast and/or other approved third-party payment providers. By making payment, you also agree to the applicable third-party terms and conditions.

All fees:

  • Are payable in advance

  • Are denominated in South African Rand (ZAR) unless stated otherwise

  • Are non-refundable, except where required by law or expressly stated in writing

Refunds, where granted:

  • Are issued at Hostigo’s sole discretion

  • Exclude third-party transaction fees

  • Do not apply to domain registrations, renewals, transfers, setup fees, or used services

Chargebacks, reversals, or payment disputes may result in immediate suspension or termination of Services.


6. Domain Registration & Reseller Disclosure

Hostigo provides domain registration, renewal, and management services as a reseller of Domains.co.za and/or other accredited domain service providers.

You acknowledge and agree that:

  • Hostigo is not the domain registry

  • Domain services are subject to the rules, systems, and policies of the relevant registry and upstream provider

  • Hostigo has no control over registry availability, pricing changes, suspensions, deletions, or disputes

All domain-related services are provided on a strictly non-refundable basis, including registrations, renewals, transfers, and redemption fees.

Hostigo shall not be liable for:

  • Failed or delayed domain registrations

  • Domain loss due to late renewals or incorrect client information

  • Registry-imposed suspensions, deletions, or disputes

It is your responsibility to ensure domain contact details are accurate, renewal dates are monitored, and registry rules are complied with.


7. Suspension & Termination

Hostigo reserves the right to suspend or terminate Services immediately and without notice if:

  • Payment is overdue

  • These Terms or any related policy are breached

  • Illegal, abusive, or harmful activity is detected

  • Hostigo’s infrastructure, reputation, or other clients are placed at risk

Upon suspension or termination:

  • Access to Services may be disabled immediately

  • Data may be permanently deleted

  • Hostigo has no obligation to retain or restore data

Termination does not relieve you of outstanding payment obligations.


8. Limitation of Liability

To the maximum extent permitted by South African law, Hostigo shall not be liable for any:

  • Loss of data

  • Loss of income, revenue, or profits

  • Business interruption

  • Indirect, incidental, consequential, or punitive damages

This applies whether the claim arises from contract, delict (tort), negligence, strict liability, or otherwise.

Hostigo’s total cumulative liability for any claim shall not exceed the amount paid by you for the affected Service during the three (3) months preceding the event giving rise to the claim.

Under no circumstances shall Hostigo be liable for the loss of a domain name, regardless of cause.


9. Privacy & Protection of Personal Information (POPIA)

Hostigo processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”).

By using Hostigo’s Services, you consent to the collection, processing, storage, and use of personal information necessary for:

  • Account creation and management

  • Billing, payments, and fraud prevention

  • Service provisioning and support

  • Legal and regulatory compliance

Personal information may be shared with third parties where reasonably necessary, including payment processors, domain service providers, infrastructure partners, and legal authorities where required by law.

Hostigo implements reasonable technical and organisational safeguards but shall not be liable for data breaches or unauthorised access caused by factors beyond its reasonable control, third-party failures, or compromised client credentials.

You are responsible for ensuring that any personal information you process using Hostigo’s Services complies with POPIA and other applicable laws.


10. Force Majeure

Hostigo shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to natural disasters, power failures, cyberattacks, acts of government, labour disputes, or upstream provider outages.


11. Amendments

Hostigo may amend these Terms at any time. Continued use of the Services after updated Terms are published constitutes acceptance of the revised Terms.


12. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.

You consent to the exclusive jurisdiction of South African courts for any dispute arising from or relating to these Terms or the Services.
